Council Meeting

Staff Members Present – Thomas Leone, Corporation Counsel and Acting City Manager; Debra McCormick, City Clerk; Nancy Hussey, Assistant Corporation Counsel; Bill Lupien, Superintendent of Engineering Services; Frank DeOrio, Director of Municipal Utilities; Lisa Green, Comptroller.

Roll Call – Mayor Lattimore, absent.  Councilors McNabb, Jacobs, Dempsey and Hunter; present.  Councilor Jacobs sat in as Acting Mayor for this meeting.

All stood for the Pledge Allegiance to the Flag.

Councilor Jacobs asked for a moment of silence.

Public to be Heard –
Joe Sarnicola, 14 Shearin St. Owasco, spoke in opposition to the USDA crow hazing that is planned for Auburn.  Mr. Sarnicola offered to serve on a committee to look for alternatives.

Barbara Baruchain, 196 Franklin St., spoke to Council about garbage bags being left out during trash pick up days.  She asked that the City enforce the code ordinance that requires garbage to be placed in containers with lids.

Theresa Zanowick, 11 Dennis St., distributed folders to each Councilor and spoke about the group home that is purchasing property on her street.  She spoke in opposition to this happening.

Denise Baschta, 10 Dennis St., spoke in opposition to the group home locating on Dennis St.

Amy Greco, 5 Dennis St., spoke in opposition to the group home locating on Dennis St.

Sean Stanyon, Clymer St., spoke to Council in support of promoting the City’s crows for tourism events.  He read from and article he wrote.
Beth Zanowich, 11 Dennis St., spoke in opposition to the proposed purchase of a home on Dennis St. by the Cayuga Seneca ARC.

Rita Sarnicola, 14 Shearin St., Owasco, spoke to encourage the City to consider ecotourism events and the use of area crows to attract visitors.

Mary Lou Picciano, 32 Cayuga St., attempted to ask Council questions, and gave Corporation Counsel, Tom Leone, a document.

Kevin Smith, Executive Director of the Cayuga Seneca ARC, explained what the ARC is planning for the property at 12 Dennis St.

Helen Farren, 5 Kearney Ave., spoke about her neighborhood and her concerns about the ARC home locating in it.

Report of City Officials – Councilor Hunter distributed a copy of a document giving the vote totals from the Village of Clifton Springs Board of Elections.  The vote was on a Local Law authorizing the creation of a public energy utility service and cost.  Mr. Hunter briefly discussed this.

Acting City Manager, Tom Leone, asked Council to amend the agenda to include Ordinance #17 of 2005.  All agreed.

Ordinances -    FIRST READ

The City Clerk read the following for the record:

Ordinance #16 of 2005 authorizing amendment to the Code of the City of Auburn at Chapter 254, entitled Solid Waste.

Ordinance #17 of 2005 authorizing amendment to the Code of the City of Auburn at Chapter 104 – Animals.

Resolutions
Appointment Resolution #173 of 2005 authorizing appointment to the Historic Resource Review Board.  Vote:  Mayor Lattimore, absent; Councilor Jacobs, McNabb, Hunter and Dempsey, aye. CARRIED

Financial Resolution ~#174 of 2005 authorizing the Comptroller to transfer Thirteen Thousand Seven Hundred Eleven ($13,711) Dollars from Contingency Account #A1990.445 into Animal Control Services Account #A3510.440.  Vote:  Mayor Lattimore, absent; Councilor Jacobs, McNabb, Hunter and Dempsey, aye. CARRIED




Council Resolution #175 of 2005 approving the request of Seneca Cayuga ARC to establish an Individual Residential Alternative (IRA) to house four (4) individuals located at 12 Dennis Street, Auburn, New York.  Council discussed this resolution.  Assistant Corporation Counsel Nancy Hussey explained Councils roll in approving the purchase.  Motion to Table by Councilor McNabb, seconded by Councilor Dempsey, all in favor.

Council Resolution #176 of 2005 requesting that the New York State Department of Environmental Conservation require that the Village of Groton treat phosphorus as a condition of the renewal of their operating permit.   Vote:  Mayor Lattimore, absent; Councilor Jacobs, McNabb, Hunter and Dempsey, aye. CARRIED

Local Law –

Local Law #2 of 2005, authorizing the City of Auburn to make application for redesignation of certain areas within the City of Auburn as an Empire Zone. ~Vote:  Mayor Lattimore, absent; Councilor Jacobs, McNabb, Hunter and Dempsey, aye. CARRIED

Other Business – Councilor Hunter discussed the Clifton Springs Local Law vote from 1997.  He discussed the feasibility and cost issues of a Public Utility Service.

Councilor Dempsey commented on the energy issue.

Acting City Manager Tom Leone reminded Council that they would be going to the Town of Sennett meeting on 12/22.
